| 为促进我国外来入侵物种管理法律法规体系完善，从根本上保障我国生物安全和生态系统不受破坏，从法律、行政法规以及部门规章、地方性法规和地方工作文件3个层次，系统梳理了我国（未包含港、澳、台地区）关于外来入侵物种管理相关的法律法规，分析和归纳了当前法律法规体系存在的问题和不足之处。结果表明：当前我国外来入侵物种管理相关的法律法规体系已经初步建成，但仍然存在专门法法律位阶不高、法律责任机制缺失和监测执法能力有待加强这3个方面的主要问题。针对上述问题，结合我国社会的实际情况，本研究提出了自上而下健全法律法规体系、完善法律责任机制以及强化监测执法能力等3个方面的完善对策。 |

| Research and suggestions on the laws and regulations of alien invasive species management in China |

| Abstract: |
| In order to promote the improvement of China’s laws and regulations on the management of alien invasive species， and fundamentally safeguard China’s biosafety and ecological system from being damaged， this study systematically combs China’s laws（do not include Hong Kong， Macao， and Taiwan regions） and regulations on the management of alien invasive species from three levels as follows： laws， administrative regulations and departmental rules， local regulations and local working documents. This research analyzes and summarizes the existing problems and shortcomings of the current legal and regulatory system. The result show that the current legal and regulatory system related to the management of invasive species in China has been preliminarily established， but there are still three main problems： the legal rank of specialized law is not high， the legal responsibility mechanism is lacking， and the monitoring and law enforcement ability needs to be strengthened. In view of the above problems， combined with the actual situation of our society， suggestions for the improvement of China’s laws and regulations on the management of alien invasive species are put forward from three aspects， improving the system of laws and regulations from top to bottom， improving the legal responsibility mechanism and strengthening the monitoring and law enforcement capacity. |
